Terms of Service

Eden FM is a registered community radio station broadcasting to the Garden Route region of the Western Cape, South Africa. We operate under license from the Independent Communications Authority of South Africa (ICASA).

Our mission is to serve the Garden Route community by providing local news, entertainment, and information programming.

You agree to use our services only for lawful purposes. You may not:

• Use our services in any way that violates applicable laws or regulations
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt our services or servers
• Use automated systems to access our services without permission
• Impersonate Eden FM, our presenters, or other users

All content on our website and broadcasts, including but not limited to text, graphics, logos, audio clips, and software, is the property of Eden FM or its content suppliers and is protected by South African and international copyright laws.

The Eden FM name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Eden FM. You may not use these marks without our prior written permission.

Music broadcast on Eden FM is licensed through relevant licensing bodies including SAMRO, CAPASSO, and SAMPRA.

When you submit content to Eden FM (including song requests, messages, competition entries, or other communications), you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and broadcast that content.

You represent and warrant that:

• You own or have the rights to submit the content
• Your content does not infringe any third-party rights
• Your content is not false, misleading, or defamatory
• Your content does not contain viruses or harmful code

Eden FM may run competitions, giveaways, and promotions from time to time. Each competition will have its own specific terms and conditions which will be announced on-air and/or on our website.

General competition rules:

• Participants must be South African residents unless otherwise stated
• Eden FM staff and their immediate family members are not eligible
• Winners may be required to participate in promotional activities
• Prizes are not transferable and cannot be exchanged for cash
• Eden FM reserves the right to substitute prizes of equal value
• Decisions of Eden FM regarding winners are final

Our live streaming service is provided for personal, non-commercial use only. You may not:

• Rebroadcast or redistribute our streams without permission
• Record streams for commercial purposes
• Use our streams in any commercial establishment without proper licensing
• Attempt to circumvent any technological protection measures

We reserve the right to restrict access to our streaming services at any time and for any reason.

Our services are provided on an "as is" and "as available" basis. Eden FM makes no representations or warranties of any kind, express or implied, regarding:

• The operation or availability of our services
• The accuracy, reliability, or completeness of any content
• The results that may be obtained from using our services
• The quality of any products, services, or information obtained through our services

News and information broadcast on Eden FM is for general informational purposes only and should not be relied upon for making any decisions.

To the fullest extent permitted by South African law, Eden FM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of (or inability to access or use) our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

Eden FM operates under license from the Independent Communications Authority of South Africa (ICASA) and complies with all applicable broadcasting regulations.

Complaints about our broadcast content may be directed to the Broadcasting Complaints Commission of South Africa (BCCSA) if they cannot be resolved directly with Eden FM.
